Terms of Service

These Terms of Service ("Terms") govern your use of the Cradle baby-tracking application and related services (the "Service") provided by Creator Lane Studios LLC ("Cradle," "we," "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (16 in the EEA/UK) and have the legal capacity to enter into this agreement to use Cradle. The Service is intended for parents and caregivers tracking their own children.

2. Your account

You're responsible for keeping your account credentials secure and for any activity under your account. Notify us immediately at info@creatorlanestudios.com if you suspect unauthorized access.

3. Subscriptions and payments

• Free tier: Logging, predictions, 7-day reports, single caregiver.
• Cradle Plus: a paid subscription, billed monthly or annually. Current pricing is shown in the App Store or Google Play listing and inside the app before you purchase. Adds unlimited caregivers, 30/90-day reports, pediatrician export, pattern signals, mom check-in trends.
• All subscriptions auto-renew through your Apple ID or Google Play account at the end of each billing period unless cancelled at least 24 hours before renewal.
• Manage or cancel subscriptions in your Apple ID Subscriptions or Google Play Subscriptions settings.
• A free trial period (typically 7 days) may apply on first subscription. The trial converts to a paid subscription unless cancelled.
• Refunds are handled by Apple or Google per their respective refund policies.

4. Acceptable use

You agree not to:

• Use the Service to harm, harass, or impersonate anyone.
• Attempt to access another user's data or bypass authentication.
• Reverse-engineer, decompile, or modify the app outside of normal use.
• Use the Service for commercial childcare-business purposes without a written agreement with us.
• Upload illegal content or content that infringes others' rights.

5. Your content

Activity logs, photos, notes, and other content you upload remain yours. By uploading, you grant Cradle a limited, non-exclusive license to store, process, and display that content within the Service to deliver features (e.g., showing your logs to invited caregivers, generating reports, providing AI coaching responses on your behalf). We don't use your data to train AI models.

6. AI features (Lila)

Lila is powered by Anthropic's Claude AI. Responses are informational only and are not medical advice. They may contain errors. Always verify with your pediatrician for any health concern. By using Lila, you authorize Cradle to send your active child's recent activity data and your message to Anthropic for the purpose of generating a response. Anthropic does not retain your conversations for model training (per Anthropic's data policy).

7. Not medical advice

Cradle, including all coaching content, predictions, and Lila responses, is not intended to diagnose, treat, cure, or prevent any disease or condition. It is a tracking and informational tool. Always consult a qualified healthcare provider for medical questions.

8. Service availability

We strive for high uptime but make no guarantee that the Service will be uninterrupted or error-free. We may modify, suspend, or discontinue features with reasonable notice.

9. Termination

You may delete your account anytime in You → Settings → Account → Delete my account. We may suspend or terminate accounts that violate these Terms. On termination, your data is purged within 30 days per our Privacy Policy.

10. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRADLE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID CRADLE IN THE 12 MONTHS BEFORE THE CLAIM. IN NO EVENT SHALL CRADLE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Changes to these Terms

We will notify you in-app and by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of [state], United States, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in [county], [state], unless local consumer-protection law provides otherwise.
